Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Nosè Initiative ("Nosè," "we," "us," or "our") governing your access to and use of the Nosè mobile application, web services, APIs, and any related features or content (collectively, the "Service").

By using the Service, you confirm that:

• You are at least 17 years of age, or have obtained parental or guardian consent.
• You have the legal capacity to enter into this agreement.
• You will comply with all applicable local, national, and international laws and regulations.

2. Description of Service

Nosè is a human-powered scam detection platform that combines AI-assisted analysis with verification by a network of trusted human nodes ("Trusted Nodes"). The Service allows users to:

• Submit screenshots or messages for scam analysis.
• Receive risk assessments by Trusted Nodes and AI.
• Participate as a Trusted Node verifier (subject to additional eligibility requirements).
• Access developer APIs for integration into third-party applications.

The Service is provided on an "as-is" basis. We do not guarantee that every analysis will be accurate, complete, or free from error. Human verification involves subjective judgment; results should be treated as advisory and not as definitive legal or financial advice.

3. User Accounts & Registration

3.1 Account Creation

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at nose.initiative@gmail.com if you suspect any unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your credentials.

3.3 Account Termination

We reserve the right to suspend or permanently terminate your account at our sole discretion, without prior notice, if we determine you have violated these Terms or engaged in conduct that is harmful to other users, Trusted Nodes, or the integrity of the Service.

4. Trusted Node Program

4.1 Eligibility

Participation as a Trusted Node verifier requires separate enrollment and approval. Trusted Nodes must maintain high accuracy standards and comply with our Verifier Code of Conduct, which is incorporated into these Terms by reference.

4.2 Responsibilities

Trusted Nodes agree to:

• Provide honest, unbiased, and good-faith assessments of submitted content.
• Not share, disclose, or misuse any content submitted for verification.
• Maintain the privacy of users who submit content for analysis.
• Not use verification tasks for any commercial or personal gain beyond the agreed compensation structure.

4.3 Removal from Program

We reserve the right to remove any Trusted Node from the program at any time if their accuracy falls below acceptable thresholds, if they violate any term herein, or for any other reason we deem appropriate.

5. Acceptable Use Policy

You agree not to use the Service to:

• Submit content that is illegal, abusive, harassing, defamatory, or that violates the rights of others.
• Attempt to reverse-engineer, decompile, or extract the source code of the application.
• Use automated tools, bots, or scripts to interact with the Service without prior written consent.
• Introduce viruses, malware, or any code designed to disrupt, damage, or gain unauthorized access to any system.
• Submit false or misleading content with the intent to manipulate analysis results.
• Circumvent any security measures or access controls within the Service.
• Resell, sublicense, or commercially exploit the Service without our express written permission.

6. Intellectual Property

6.1 Ownership

All intellectual property rights in the Service, including but not limited to the software, algorithms, UI/UX design, trademarks, logos, and content, are owned by or licensed to Nosè Initiative. These Terms do not grant you any rights to our intellectual property except as expressly stated.

6.2 User Content

By submitting content (e.g., screenshots, messages) to the Service, you grant Nosè a non-exclusive, royalty-free, worldwide license to process and analyze that content solely for the purpose of delivering the requested analysis. We do not claim ownership over your submitted content. Submitted content is processed ephemerally and is not retained beyond the scope defined in our Privacy Policy.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read our Privacy Policy carefully to understand how we collect, use, and protect your personal information.

8. Disclaimers & Limitation of Liability

8.1 No Guarantee of Accuracy

Nosè provides scam detection as an assistive tool. We make no warranty that our analysis results are accurate, complete, or suitable for any specific purpose. You acknowledge that no AI or human verification system is infallible.

8.2 Limitation of Liability

To the maximum extent permitted by applicable law, Nosè Initiative and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:

• Financial losses resulting from acting on a scam analysis result.
• Loss of data, reputation, or business opportunity.
• Unauthorized access to your account or submitted content.

8.3 Indemnification

You agree to indemnify, defend, and hold harmless Nosè Initiative from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

9. Third-Party Services

The Service may integrate with or link to third-party services (e.g., Google Cloud, Firebase). Your use of such third-party services is governed by their respective terms of service and privacy policies. Nosè is not responsible for the practices or content of any third-party services.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Surabaya, Indonesia.

For users in other jurisdictions, nothing in these Terms shall limit your rights under mandatory consumer protection laws applicable in your country of residence.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via in-app notification or email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
